Governing law and dispute resolution
These terms are governed by the laws of the State of Minnesota. Disputes arising from your project or website use will first be addressed through good-faith discussion with Smart Construction & Remodeling, Inc.. Unresolved disputes will be handled by binding arbitration in Anoka County, Minnesota, where Smart Construction & Remodeling, Inc. maintains its office.
Limitation of liability
Smart Construction's total liability for any single project is limited to the contract value of that project. Smart Construction is not liable for indirect, incidental, or consequential damages, including damages from delay, weather, or third-party actions outside of contractor control.
Minnesota pre-lien notice
Per Minnesota Statute §514.011, a pre-lien notice is provided to homeowners before any residential improvement contract exceeding $1,000 is signed. The notice explains your rights and protections under Minnesota's mechanic's lien law.
